The Constitution is planned to guide law and its political society, and framework. It distinguishes the state (its physical presence and its border), individuals and their major rights, state’s protected law and orders, furthermore the constitutional structure and foundation of the establishments and the nation’s military. The United Sates’ Constitution was the first ever composed almost two hundred years back. This constitution is still essentially today with a not very many changes or revisions. In this article we will discuss the differences that exist between American constitution and constitution of Pakistan.
American Constitution
The American Constitution built up America’s national government and essential laws, and ensured certain fundamental rights for citizens of America. It was marked on September 17, 1787, by agents to the Constitutional Convention in Philadelphia, managed by George Washington. Under America’s first administering record, the Articles of Confederation, the national government was feeble and states worked like free nations. Pakistan Constitution
The Constitution of the Islamic Republic of Pakistan, otherwise called the 1973 Constitution is the incomparable law of the State of Pakistan. It is planned by the administration of Zulfiqar Ali Bhutto, with extra help from the opposition parties of country; it was affirmed by the Parliament on April 19 and approved on 14 August 1973. The first archive was planned by veteran government official M.G.B. Bizenjo and Abdul Hafiz Pirzada. Once the then law pastor Abdul Hafiz Pirzada said in an interview that the designer of 1973 constitution was Mir Ghaus Baksh Bizenjo. It is Pakistan’s third constitution and has been changed many times.
American Constitution VS Pakistan Constitution
The differences between both constitutions are given below
- Created:
American constitution was created on 17th of September 1787.
Pakistan constitution was created on 19th of April 1973.
- Ratified:
American constitution was ratified on 21st of June 1788.
Pakistan constitution was ratified on 14th of August 1973.
- Power of branches:
According to American constitution, all the three branches i.e. executive, legislative and judicial have same amount of power.
In Pakistan constitution, the branches don’t have equal distribution of power as its executive branch has more power as compare to other branches.
- Decision making:
According to American constitution, the president of United States of America has no power to make any of the decision by himself but he have to consult with the legislative branch or senate.
In case of Pakistan constitution, the president has all powers to make the decisions. There is no need to consult with any of the branch but he can consult with prime minister.
- Judicial branch:
In American constitution, the judicial branch has the right to remove president if he made any wrong decision or action. This branch has a strict eye on all the matters including executive and legislative branch.
In Pakistan constitution, the judicial branch has no right to raise any question or objection on actions and decisions of president of Pakistan. It only deals with civil cases not cases of executive and legislative matters.
- Head:
According to constitution of America, the president is the chief of state and government.
In Pakistan constitution, the president is the head of state only whereas prime minister has the authorities of government.
Conclusion
From the above article we come to know that American constitution was created on 17th of September 1787 and was ratified on 21st of June 1788 whereas Pakistan constitution was created on 19th of April 1973 and was ratified on 14th of August 1973. In American constitution, all branches have equal power and president in only concerned with legislative branch but in Pakistan constitution executive branch has more power as compare to other branches and president has power of decision making. Judicial branch has right to remove president in American constitution but this is not case in Pakistan constitution. In American constitution, president is the head of government and state but in Pakistan constitution president is head of state and prime minister is head of government.
